Connecticut man awarded $4.2 million for unnecessary surgery

When a patient has surgery, he or she has put his or her trust in the doctor, surgeon and other medical staff. A patient usually believes that the surgery is needed; however, as the case below demonstrates, that is not always the case.

A 58-year-old man from Wallingford, Connecticut, filed a medical malpractice lawsuit against a doctor and a medical group after he underwent surgery in 2008. The surgery was deemed necessary by the doctor in order to remove a mass that was in his neck.

The man, according to his lawsuit, suffered nerve damage during the surgery, which has left him in pain. His left shoulder was damaged and he has not been able to work. Now, he cannot use his left arm during physical activities.

The man’s trial lasted for three weeks. The jury awarded the man $4.2 million for the loss of use of this left shoulder.

The tragic part of this case is that it was later determined that the surgery wasn’t needed. Antibiotics could have treated the mass in the man’s neck.

Medical malpractice encompasses many different actions or inactions by medical staff. From wrong site surgery to medication errors to unnecessary surgery, patients should not be injured or have their current condition worsened.
