Doctor in brain medical malpractice case won't be sanctioned

When a patient has to have surgery, he or she is likely scared and worried. However, as patients, we believe that the surgeons we put our faith in will provide us with the proper care. Unfortunately, this doesn't always happen. While you would think that medical personnel who commit egregious errors would be disciplined by the state medical board, that doesn't always happen either.

A case in point involves a woman who suffered from Cadasil Syndrome. This is a condition that greatly increases the risk of stroke. In an effort to prevent such a stroke from occurring, a surgeon with SSM St. Clare Health Center in Fenton, Missouri, operated on the woman's brain in April 2013. Unfortunately, he operated on the wrong side of her brain.

The results of the wrong site surgery were tragic. She has trouble speaking clearly and she must now use a wheelchair. The woman and her family filed a medical malpractice lawsuit against the doctor. It was settled for an unreported amount in January 2014.

The woman received a letter from the Missouri Board of Registration for the Healing Arts. It stated that the matter was now closed and that there would be no action taken against the surgeon. This was shocking for the woman's attorney, who said he doesn't know what it would take a Missouri doctor to get a slap on the wrist, let alone a strong action.
